Abstract

Introduction: The article addresses the challenges of habeas data in the protection of personal data in the Ecuadorian legal system. Through a comprehensive analysis, the limitations and strengths of habeas data as a legal tool to safeguard the privacy and personal information of citizens are examined. The study reviews Ecuadorian legislation, relevant jurisprudence and compares the regulatory framework with international standards. The main barriers are identified, such as the lack of clarity in the regulations and insufficient awareness about digital rights. Methodology: The research uses a qualitative approach, using documentary analysis and interviews with legal experts. Results: The results reveal an urgent need to reform and update existing laws, as well as improve education on personal data rights among the population. Discussion: focuses on the importance of a robust and adaptable legal framework that can respond to emerging technological challenges. Conclusion: Although habeas data is a valuable tool, its effectiveness depends on political will, legislative updating and social awareness.

Luis Alberto Alzate Peralta, Universidad Bolivariana del Ecuador

Luis Alberto Alzate Peralta has been an undergraduate and graduate professor at the Universidad Bolivariana del Ecuador since April 2022 and at the Instituto Superior Universitario Bolivariano de Tecnología since August 2012. He has held various teaching positions at other educational institutions such as Universidad San Gregorio de Portoviejo, Universidad Tecnológica Empresarial de Guayaquil, and Universidad Simón Bolívar. He holds a Master's Degree in Quality Evaluation and Certification Processes in Higher Education from the International University of La Rioja. Doctor in Pedagogical Sciences from the Universidad de Oriente. Master in Medical Education from the University of Medical Sciences of Villa Clara.
