The Integral Protection of Children and Adolescents in Ecuadorian Case Law: Analysis and Application

Introduction: This article analyzes the comprehensive protection of children and adolescents (CHI) in Ecuadorian jurisprudence, addressing how the courts have interpreted and applied the constitutional and regulatory principles related to their rights. Objective: Through a critical review, it examines the evolution of the legal approach toward a doctrine of comprehensive protection, in contrast to previous welfare-based models. Methodology: The research adopts a qualitative approach, based on documentary analysis of rulings issued by the Constitutional Court and other judicial bodies, as well as a review of national regulations and international human rights instruments. Results: Significant progress is evident in the recognition of the best interests of the child as a guiding principle, as well as in the progressive incorporation of a rights-based approach in judicial decisions. However, challenges persist in the uniform application of these standards at all jurisdictional levels. Discussion: The need to strengthen the training of justice officials and consolidate jurisprudential criteria that guarantee consistency in the interpretation and application of children and adolescents' rights is highlighted. Conclusion: Although case law has helped position comprehensive protection as a central axis of the legal treatment of children and adolescents, its full implementation requires institutional reforms, sustained judicial commitment, and comprehensive public policies.
