Homotransphobic hate crimes and intersectionalities in Portugal: Analysis of Official Cases 2015-2020

Abstract

Introduction: This article aims to map and analyze in an intersectional way the official cases of violence against sexual and gender diversity registered in the Public Security Forces and the Public Ministry and investigated by the Judiciary Police – PJ, between the years 2015 and 2020, verifying beyond homotransphobia, what other types of oppression are present in these hate crimes in Portugal. The entire process of mapping and identifying cases was carried out by the Judiciary Police in the Criminal Information System – SIC using keywords that served as a search source, where 33 Criminal Inquiries investigated by the PJ with homophobic and/or transphobic motivations were found. After requests for authorization to collect data, 29 processes were authorized to be consulted. Methodology: The methodological approach used was based on a qualitative, descriptive and documentary investigation. Results and Dissiion: The results show that the majority of criminal complaints analyzed presented 6 types of intersectional oppression: discrimination due to aporophobia, religious intolerance, prejudice against people with disabilities, racism, sexism and serophobia. Conclusions: Most reported situations of violence have serious consequences for their victims, affecting all individuals regardless of their Sexual Orientation, Gender Identity, Gender Expressions and Sexual Characteristics – OIEC.
